Even though it is not required to use an attorney to close on your property in New Jersey, it is usual and customary to have representation for many reasons!

Hiring an attorney will safeguard your rights and protect your substantial financial decisions. However, New Jersey does not require a real estate attorney to close on a house or other property. Real estate attorneys advise on drafting contracts, property inspection issues and disclosures, ownership and title issues, and closing procedures. The attorney is a valuable partner with you as their client to ensure legal compliance and limit any future problems.

As an agent, I have expertise in marketing property for sellers, evaluating all offers, guiding buyers to their dream homes or investment properties, and assessing the value of your property.  Also, I conduct inspections, advise service providers, and guide clients through every step in the transaction. BUT, only an attorney is qualified to provide legal advice.  Some of the duties an attorney provides:

Drafting and Revising Contracts

Real estate attorneys review and explain the purchase and sale contract, including the duties and rights of the buyer and seller.  A Realtor® prepares a form contract and the lawyer drafts the amendments during attorney review. Real estate contracts contain many provisions that an attorney modifies to satisfy client needs.  Below are listed some of these amendments:

Earnest Deposit
Inspection Issues
Financing Contingency
Appraisal Contingency
Clear Title
Representations such as intended property use
Property Included and Excluded
Complex Circumstances 

Attorneys also draft unique provisions (complex circumstances) when addressing delicate legal circumstances, such as structural defects or any issue that may arise during the transaction.  Together, working a close relationship with me as your Realtor Representative brings the purchase to a satisfying close.  

As you can see, there are many issues and moving parts to a successful close.  Mortgage and lien holders must be paid off.  Payment arrangements via wire or certified checks are established. Settlement statements and closing disclosures showing disbursements of funds must be approved. Closing documents, including deeds and mortgages, must be recorded.
